All policies of The Henry Ford posted to the Site. There are many policies, designed to enhance the visitor experience, to strengthen the relationship between The Henry Ford and its community, and to help The Henry Ford achieve its mission: “The Henry Ford provides unique educational experiences based on authentic objects, stories, and lives from America's traditions of ingenuity, resourcefulness and innovation. Our purpose is to inspire people to learn from these traditions to help shape a better future.”
Overview: These TOU are intentionally brief. Websites are no longer new or mysterious and visitors know what is expected of them – they are expected to comply with the law, not to harm the technology infrastructure of the website, and to conduct themselves in a manner that is ethical. Each Visitor agrees:
Their use of content at the Site is subject to The Copyright Policy.
The Site may provide links to third party web sites. The Henry Ford does not control those third party sites or their policies, including privacy policies.
They may use the Site solely for personal, noncommercial use.
They shall not use automated technology to copy content, monitor activity, or scrape data from the Site. The foregoing does not limit the right of persons to use technology to enhance/enable their ability to view, hear, and lawfully download content made available by The Henry Ford at the Site.
They have the legal right to upload to the site any content and resources (“Resources”) they upload, such Resources do not violate the rights of any third party, and they authorized third parties to use the Resources in accordance with the stated policies for such Resources. By way of example, The Henry Ford may enable educators and parents to share Resources for educational purposes.
They shall comply with applicable law and shall also comply with ethical community standards in terms of the uploading of content, comments, and conduct targeting The Henry Ford, other visitors to the Site, visitors to The Henry Ford Museum of American Innovation and to Greenfield Village, and third parties.
The Henry Ford does not charge a fee to access the Site. However, visitor access to the Site, and in some cases charges to visitors to access the Site, may be affected by technology and services of third parties, such as technology platforms, Internet Service Providers, providers of power, security systems, and the technology used by Visitor to access the Site. The Henry Ford has no responsibility or liability for the conduct or practices of third parties, and makes no representation or warranty as to access to content, accuracy of information, security, or uptime.
Access to the Site is a privilege. The Henry Ford may suspend or terminate access of a Visitor to the Site in the exercise of its discretion.
Legal Disclaimer. ACCESS TO AND USE OF THE SITE IS “AS IS AND WHERE IS”. ALL WARRANTIES ARE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES BASED ON CUSTOM AND PRACTICE.
Limitation of Liability for Damages. THE HENRY FORD SHALL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR SPECIAL DAMAGES, OR LOST PROFITS RESULTING FROM ACTIVITY RELATING TO THE SITE. DIRECT DAMAGES SHALL BE LIMITED TO FIFTY DOLLARS (U.S. $50).
Limitations of Actions. Any claim relating to these TOU or the Site must be commenced within one (1) year after the claim or cause of action arises, otherwise such claim or action is permanently barred.
Dispute Resolution. In the event of a dispute between a visitor and The Henry Ford, the parties shall use their best efforts to resolve any dispute through good faith business negotiations. Any disputes not so resolved shall be submitted to facilitative mediation online (by way of example, https://www.jamsadr.com/online?tab=overview. If the parties do not agree upon a mediation and mediation procedure within thirty (30) days of the initial request of a party for such online mediation, a party may commence litigation solely in the Circuit Court for the County of Wayne, Michigan, or the United States District Court for the Eastern District of Michigan, Southern Division. The parties stipulate to venue and personal jurisdiction in such courts and waive any application of the doctrine of forum non conveniens.
General Terms. These TOU, including all referenced policies and additional terms, is the entire understanding of the parties with respect to the subject matter and replaces all prior and contemporaneous written and oral communications, promises, or understandings. This TOU may be amended only by the issuance by The Henry Ford of updated TOU. Visitor and The Henry Ford consent to electronic notices, electronic signatures, and electronic documents. This Agreement shall be governed by the State of Michigan and the federal laws of the United States of America, as applicable.
